1. Agreement to Terms

By accessing or using EmergentFlow ("Service"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

EmergentFlow is a visual AI workflow automation platform that allows users to create, execute, and share automated workflows ("Flows") using a node-based interface. The Service includes:

  • Visual flow builder with drag-and-drop nodes
  • AI/LLM integrations (via server-provided or user-provided API keys)
  • Third-party integrations (webhooks, email, messaging platforms)
  • Cloud storage for flows (Pro tier)
  • Community gallery for sharing custom nodes

3. Account Registration

To use certain features, you must register for an account. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized access

You must be at least 18 years old to create an account.

4. Subscription & Payments

4.1 Free Tier

Free accounts receive 50 daily credits that reset every 24 hours. Credits not used do not roll over. The free tier exists to help users experience the platform before committing to a subscription — it allows us to keep the service sustainable while giving new users a meaningful trial of cloud AI capabilities.

4.2 Pro Subscription

Pro subscriptions are billed monthly at $19/month. Pro accounts unlock BYOK (Bring Your Own Key) access to all AI providers including OpenAI, Anthropic Claude, Google Gemini, Groq, DeepSeek, and xAI Grok. Pro users pay AI providers directly with their own API keys — we take no markup on API costs. Pro also includes cloud sync, advanced agents, and all premium features.

4.3 Billing

Subscriptions automatically renew unless cancelled. You may cancel at any time through your account settings or Stripe billing portal. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial months.

4.4 Price Changes

We reserve the right to modify pricing with 30 days notice. Existing subscribers will be notified before any price increase affects their subscription.

5. Acceptable Use

You agree NOT to use the Service to:

  • Violate any applicable laws or regulations
  • Send spam, phishing, or malicious content
  • Harass, abuse, or harm others
  • Infringe on intellectual property rights
  • Attempt to gain unauthorized access to systems
  • Reverse engineer or decompile the Service
  • Use automated systems to abuse rate limits
  • Create flows that generate illegal, harmful, or adult content
  • Resell access to the Service without authorization

6. API Keys & Third-Party Services

6.1 Server-Provided AI (Free Tier Only)

Free tier users access AI features through our server-provided API keys (currently Google Gemini lightweight models). Usage is subject to daily credit limits and rate limiting. This is provided as a trial experience only.

6.2 Bring Your Own Key (BYOK) - Pro Only

Pro subscribers may provide their own API keys for AI providers (OpenAI, Anthropic, Google, Groq, etc.). Your API keys are stored locally in your browser and are your sole responsibility. We are not liable for charges incurred on your third-party accounts. You pay AI providers directly at their published rates with no markup from us.

6.3 Third-Party Terms

When using third-party integrations (Twilio, Discord, Slack, etc.), you are also bound by their respective terms of service.

7. User Content

7.1 Ownership

You retain ownership of flows, custom nodes, and content you create. By sharing content to the Community Gallery, you grant us and other users a non-exclusive license to use, display, and adapt that content.

7.2 Responsibility

You are solely responsible for content created through your account. We do not monitor all content but reserve the right to remove content that violates these terms.

8. Data & Privacy

Your use of the Service is also governed by our Privacy Policy. Key points:

  • Flow data may be stored locally (Free) or in our cloud database (Pro)
  • API keys provided via BYOK are stored in your browser only
  • We collect basic usage analytics to improve the Service
  • We do not sell your personal information

9. Service Availability

We strive for high availability but do not guarantee uninterrupted access. The Service is provided "as is" without warranties of any kind. We may:

  • Perform maintenance with or without notice
  • Modify or discontinue features
  • Impose usage limits to ensure fair access

10. Limitation of Liability

To the maximum extent permitted by law, EmergentFlow and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of profits, data, or business opportunities
  • Costs incurred from third-party API usage
  • Damages from unauthorized access to your account
  • Service interruptions or data loss

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Termination

We may suspend or terminate your account if you violate these terms. You may delete your account at any time. Upon termination:

  • Your access to the Service will cease
  • Cloud-stored data may be deleted after 30 days
  • No refund will be provided for unused subscription time

12. Changes to Terms

We may update these terms at any time. Material changes will be communicated via email or in-app notification at least 14 days before taking effect. Continued use after changes constitutes acceptance.
