Terms of Service

1. Who we are and who these terms cover

EmergentFlow ("we", "us") is operated from Kalispell, Montana. These terms apply to anyone who creates an account or uses emergentflow.io ("you"). If you use EmergentFlow for a business, you agree to these terms for that business and confirm you're allowed to.

2. What EmergentFlow does

EmergentFlow collects the customer inquiries that reach your business (from email inboxes you connect, your hosted request-a-quote page, and forms you connect), sorts them, and uses AI to draft a reply based on the business profile you give us. You review each draft and decide whether to send it, change it or skip it. Approved replies are sent from your own connected email account.

3. You approve what gets sent

• You are responsible for every message sent from your account. Read each draft before you approve it. Approving a draft, or using the one-tap approve link, sends it.
• Some messages can go out without a tap, but only if you leave them on or turn them on: the short after-hours acknowledgment, and (on Pro) auto-send rules you set up. Those messages are sent on your behalf and are your responsibility too. You can switch them off in Settings.
• Keep your business profile accurate. Drafts are based on what you tell us about your services, prices, hours and policies.
• Only connect inboxes and forms you're authorized to use, and follow the laws that apply to how you contact customers.

4. AI drafts can be wrong, and replies aren't guaranteed

Drafts are written by an AI model. We instruct it to use only the facts you provide and never to invent prices, availability or promises, but it can still make mistakes, misread a message, or sort an inquiry wrongly (for example, mark a real customer as spam). That's why nothing is sent without your approval unless you choose otherwise.

We work hard to keep the service reliable, but we don't guarantee that every inquiry will be received, detected, drafted, delivered or answered, or answered within any particular time. Email providers, spam filters, outages and settings outside our control can delay or block messages. Keep an eye on your own inbox too. We are not responsible for jobs, revenue or customers lost because a message was missed, delayed or wrong.

5. Free trial

New businesses get a free trial of 14 days with up to 50 inquiries. No card is needed. When the trial ends, AI drafts pause until you choose a paid plan; inquiries keep arriving and nothing is deleted. We may limit trials to one per business.

6. Plans, billing and renewal

• Starter is $99 per month (300 inquiries a month). Pro is $249 per month (1,500 inquiries a month). Prices are in US dollars and don't include any sales tax that applies.
• Plans are billed monthly in advance by our payment processor, Stripe, and renew automatically every month until you cancel. If you subscribe during your trial, you're not charged before the trial ends.
• If you reach your monthly inquiry limit, new inquiries are still collected but don't get AI drafts until the next month or until you upgrade.
• If a payment fails, Stripe retries it for a few days. If it still fails, your subscription may be canceled and drafts paused.
• We may change prices with at least 30 days' notice by email. A price change applies from your next billing period after the notice period. Founding pricing (below) doesn't go up.
• Optional done-for-you setup is a one-time $499. It isn't refundable once we've started the setup work.

7. Founding pricing

The first 10 businesses to subscribe get founding pricing: $79 per month for Starter or $199 per month for Pro, plus done-for-you setup at no charge. Founding pricing stays the same for as long as that subscription stays active without a break. It ends if you cancel or the subscription ends for non-payment, and it can't be transferred to another business. Want to switch between Starter and Pro? Email us and we'll keep your founding price. Spots are counted when checkout completes; the number of spots left shown on our site is updated as that happens.

8. Cancelling

You can cancel any time from Settings (Manage billing). There are no contracts or cancellation fees. After you cancel, you keep access until the end of the period you've paid for, and you won't be charged again. We don't give refunds for partial months, except where the law requires it or where we choose to.

9. Acceptable use

Don't use EmergentFlow to send spam or bulk unsolicited email, to harass or deceive anyone, to send unlawful content, or to process information you have no right to. Don't try to break, overload, probe or reverse-engineer the service, get around its limits, or access other people's accounts. We may suspend accounts that do.

10. Your data and your customers' data

You own your business information and your customers' messages. You give us permission to store and process them only to run EmergentFlow for you: to receive inquiries, draft and send replies, show you your inbox and reports, and support you. We process your customers' information on your behalf; you're responsible for having the right to share it with us and for any notices your customers are owed. How we handle data is described in our Privacy Policy. You can ask us for a copy of your data or to delete it at any time.

11. Other services you connect

EmergentFlow works with services like Gmail, Google Workspace, Outlook, Microsoft 365 and website form tools. Your use of those services is governed by their terms, and we're not responsible for their availability or actions. You can disconnect them at any time.

12. Disclaimers and limits on our liability

EmergentFlow is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose and that the service will be uninterrupted or error-free.

To the fullest extent the law allows, we won't be liable for indirect, incidental, special or consequential damages, or for lost profits, revenue, jobs, customers or data. Our total liability for any claim relating to EmergentFlow is limited to the amount you paid us in the three months before the claim, or $100 if that's more.

13. Indemnity

If someone makes a claim against us because of messages sent from your account, content you provided, or your breach of these terms or the law, you agree to cover our reasonable costs of dealing with it.

14. Studio (accounts created before Front Desk)

Accounts created before the launch of the current EmergentFlow can keep using Studio, the earlier workflow builder, for a limited transition period that we announce by email. Studio is provided as is, isn't sold to new customers, and closes for those accounts when the transition period ends. Please export anything you want to keep before then.

15. Ending these terms, governing law and changes

You can stop using EmergentFlow and delete your account at any time. We may suspend or close an account that breaks these terms, or stop offering the service with reasonable notice and a refund of any prepaid, unused period. These terms are governed by the laws of the State of Montana, and disputes will be handled in the state or federal courts serving Flathead County, Montana. If we make material changes to these terms, we'll email account owners at least 14 days before the changes take effect.
